Please read these terms before registering or bidding. Bids are binding, winning bidders are responsible for their purchases, and auction-specific payment rules apply.
1. Agreement and eligibility
These Terms & Conditions govern your use of Discount Depot Auctions and your participation in auctions offered through the site. By creating an account, accepting auction terms, or placing a bid, you agree to these terms and any additional terms displayed for the applicable auction.
You must be at least 18 years old and legally able to enter into a binding contract. You are responsible for providing accurate account information and keeping your login credentials secure.
2. Auction-specific terms control
Each auction may have its own opening and closing schedule, payment policy, fulfillment rules, and other notices. Discount Depot Auctions currently uses standard local pickup hours across auctions: Tuesday & Wednesday: 11 AM–5 PM and Friday & Saturday: 11 AM–5 PM. If we clearly post a special pickup arrangement or another auction-specific term that conflicts with a general term on this page, the specific notice controls for that auction or lot.
3. Bids are binding
All bids are final and binding once accepted by the auction system. Bids cannot be deleted or retracted because you changed your mind, entered an amount you did not intend, or failed to review the lot details. Before submitting a bid, confirm the lot, amount, condition, pickup requirements, and applicable fees.
4. Protected proxy and maximum bidding
You may enter the highest amount you are willing to pay. Your confidential maximum is not displayed to other bidders. The system advances the public bid only as needed under the configured bid increment schedule, up to your maximum.
If two bidders have the same maximum, the bidder whose equal maximum was recorded first receives priority. A submitted maximum may be increased but is not retractable or reducible through the normal bidding flow.
5. Closing times, staggered close, and extensions
Lots may close at staggered times rather than all at once. Unless an auction states otherwise, Discount Depot Auctions uses a two-minute soft close: an accepted bid during the final two minutes resets that individual lot to approximately two minutes remaining. Additional accepted bids during the extension period may extend that lot again. Other lots keep their own schedules.
The server-recorded closing time and auction records control. Countdown displays are provided for convenience and may be affected by network delay, browser timing, or device settings.
6. Winning bids, buyer's premium, and sales tax
The winning bidder is obligated to purchase each lot won. A 12% buyer's premium is added to the winning bid unless the applicable auction expressly states otherwise.
Applicable sales tax is added as required by law and the auction's location and tax settings. Current Dixon pickup auctions use an 8.375% sales-tax rate on the taxable amount, including the buyer's premium. Approved tax-exempt bidders may receive different tax treatment where legally permitted.
7. Payment policies
The payment policy is displayed for each auction. Some auctions may be Pay at Pickup, while future auctions may require an authorized card on file or other approved payment method before bidding.
For Pay at Pickup auctions, winning bidders pay in person at pickup and are not automatically charged solely because a card is saved. Saving a card with Square does not itself create a charge. If a future auction is clearly marked as card-required or automatic-payment, the applicable auction terms and card authorization will explain when charges may occur.
8. Invoices
Invoices may include the winning bid amount, buyer's premium, applicable taxes, and any other auction-specific charges disclosed before bidding. You are responsible for reviewing your account and invoices after an auction closes. If you believe an invoice contains a calculation or lot-assignment error, contact us promptly.
9. Pickup and removal
Unless a lot or auction expressly states otherwise, purchases must be collected at our primary Dixon pickup location: 529 North Adams Street, Dixon, CA 95620. Standard auction pickup hours are Tuesday & Wednesday: 11 AM–5 PM and Friday & Saturday: 11 AM–5 PM.
Buyers are responsible for bringing an appropriate vehicle, securing their load, and arranging adequate help or equipment for large or heavy items. Staff loading assistance may be limited. We may require government-issued photo identification to verify the account holder or authorized pickup person.
Failure to pay for or pick up purchases during the available pickup period may result in account restrictions, forfeiture, relisting, storage or handling consequences, or other remedies stated in the applicable terms, subject to applicable law.
10. Shipping and fulfillment
Shipping is not available unless the specific auction or lot clearly states that shipping is offered. If the site displays "Shipping Coming Soon," bidders should assume the lot is pickup only. Do not bid based on an expectation that an exception will be made.
11. Condition, inspection, and as-is sales
Discount Depot Auctions sells liquidation, overstock, return, surplus, shelf-pull, open-box, pre-owned, and other merchandise. Items may have packaging damage, cosmetic wear, missing accessories, incomplete documentation, defects, or other issues.
Unless a listing expressly states that functionality was tested, no representation is made that an item was function-tested. Condition grades are based on the information and limited inspection available to us. Review all photos, descriptions, and condition notes before bidding.
All merchandise is sold AS IS, WHERE IS, with all faults, and all sales are final except where required by law or where Discount Depot Auctions determines that a material listing error warrants a remedy. See the Condition Guide for grade definitions.
12. Listing errors, withdrawals, and auction changes
We may correct clerical, catalog, image, description, scheduling, or technical errors and may withdraw, postpone, pause, cancel, reopen, or reschedule a lot or auction when reasonably necessary to protect the integrity of the auction or address an operational issue. We may reject or void bids associated with fraud, manipulation, obvious system errors, or prohibited conduct.
13. Prohibited conduct
You may not manipulate bidding, use multiple accounts to influence prices, interfere with another bidder, attempt unauthorized access, exploit software or security vulnerabilities, submit fraudulent payment information, or use the service for unlawful activity. We may suspend or close accounts and restrict bidding when reasonably necessary to protect bidders, the auction house, or the integrity of the platform.
14. Technology and service availability
We work to keep the site and bidding system available and accurate, but internet services can experience outages, latency, device issues, or third-party service interruptions. We do not guarantee uninterrupted access. Our database and server records are the authoritative auction records to the extent permitted by law.
15. Taxes and tax-exempt bidders
Bidders are responsible for providing valid exemption documentation before tax is removed where applicable. Tax-exempt treatment is not guaranteed until documentation has been reviewed and approved. If self-service certificate upload is not available, contact us before the applicable invoice is settled.
16. Intellectual property
The Discount Depot Auctions website, branding, original text, software, and site design are protected by applicable intellectual-property laws. You may use the site for personal auction participation but may not copy, scrape, republish, reverse engineer, or commercially exploit protected site content except as permitted by law.
17. Disclaimer and limitation of liability
To the maximum extent permitted by law, Discount Depot Auctions does not provide warranties beyond those expressly stated in a lot listing or required by law. We are not responsible for indirect, incidental, special, or consequential losses arising from use of the site, auction participation, delayed pickup, third-party services, or item condition, except where such limitation is prohibited by law.
18. Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute that is not otherwise resolved between the parties will be handled in a court or forum with proper jurisdiction, subject to applicable law.
19. Changes to these terms
We may update these Terms & Conditions from time to time. The current version will be posted on this page with its updated date. Auction-specific terms accepted for a particular auction may be separately versioned and retained with your acceptance record.
